Mechanical Bull/Inflatable Unit Contract

Pre-existing Health Conditions: WARNING! Individuals with head, neck, back or any other muscular or skeletal injuries or disabilities, pregnant women, individuals with pre-existing injuries, small children, and others who may be susceptible to an injury from falls, bumps, or bouncing, are NOT permitted in the unit at any time.

General Release/ Indemnity/Hold Harmless: I understand and acknowledge that play on an amusement device entails both known and unknown risks including, but not limited to physical injury from falling, slipping, crashing, colliding, emotional injury, paralysis, distress, damage, or death to any participant. I hereby voluntarily release, indemnify, and forever discharge and hold harmless Rosy’s Fun House Party Rentals, LLC. from any and all liability claims, demands, causes, or rights of action whether personal to me or to a third party, which are in any way connected with participation in this activity, including those allegedly attributable to negligent acts or omissions. Should anyone acting on behalf of Rosy’s Fun House Party Rentals, LLC. Be required to incur attorney’s fees and costs to enforce this agreement, I expressly agree to indemnify and hold Rosy’s Fun House Party Rentals, LLC. harmless for all such fees and costs. In the event I, the undersigned, or any of my participants file a lawsuit against Rosy’s Fun House Party Rentals, LLC., it is agreed to do so solely in the state of California. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portion shall remain in full force and effect. I acknowledge responsibility for the return of the equipment in the same condition as it was received. If returned in a destroyed or irreparable condition, I shall be liable for full monetary value of $8000. I shall be liable for any and all reparable damages to the rental equipment and responsible for the full cost of the repairs. I, the undersigned, agree to follow all rules listed below while using or participating with the rented amusement device.

Rules: Please remove footwear and any sharp items of jewelry, eyewear, hair accessories, etc.… *Riders must be sober. No riders under 18 years of age. Only 1 rider at a time. No animals permitted on the ride. If rental equipment is not available for pickup or return on DUE DATE/TIME, a charge of ½ of the original rental price will be due. Telephone orders have the same value as a Rental Agreement Signature and shall be treated as such. Rosy’s Fun House Party Rentals, LLC. shall not be responsible for unfavorable conditions such as high winds, rain, electrical outages, etc.…

Customer agrees to provide his/her own liability insurance.

If customer does not own the property, he/she must get permission from the owner before signing this contract.

Customer understands that a representative of Rosy’s Fun House Party Rentals, LLC. will show them how to correctly use the mechanical bull.
